It is standard practice, for Alfonso X of Castile,1 to reinvent the means of writing the law. He does not limit himself to compiling or revising existing legal statutes; rather, he elevates (...) the corpus of the law to the level of juridical science. Dominating the meaning of the word—its hermeneutics and its relation to truth, lies, rhetoric, history, and poetry—is also the key to dominating juridical discourse itself and its capacity for creating certainty. Or, at least, for controlling uncertainty. Uncertainty, that is to say, the ambiguity in the interpretation of the relationship between words and things, appears to be one of the targets of Alfonsine juridical science.It is in the institutions that one can best study this desire for control. In particular, the need for control becomes visible in the court and the places related to it (the palace, chamber, or bedroom), codified by the law in order to put justice into action, in the representation of power, in cultural exchange, in education, and in recreation. Here legislation acquires a special significance with respect to the word, to narration, and to rhetoric. This is a philological problem: How does one compose and administer a text capable of controlling its own interpretation? How does one transpose this same dynamic to the institutions? How does one transmit this notion from the institution to those who inhabit it and who are, after all, the subjects of the legal science?It is therefore fitting to examine legislation about legal discourse, which is, in itself, the theory of law—not, however, in its abstract aspects but rather in the concrete elements of the formation of a legal vocabulary, in the way in which words, whose semantic and hermeneutic problems are clear, give life to this legal vocabulary. How is legal discourse constructed? In what way is it transmitted? What are the consequences of its dissemination? In what way is the law in charge of words, in particular, those expressed in the institutions?Perhaps the problem is philological, in the sense supposed by Giambattista Vico. Vico, in his Principi per una scienza nuova [1: 10] proposed that the study of philosophy, as a science of truth could not exist independently without a philology, the origin of the conscience of certainty (coscienza del certo). Attaching myself, then, to this idea of certainty (although not, of course, from Vico’s perspective) throughout this study I shall call “the space of certainty” the theoretical and conceptual construction (which is of both a philological and textual character) stipulated by the legislator in an attempt to control the distinct concepts related to the legal word, its institutional statute and its legal, moral, and cultural hermeneutics. I shall thus attempt to understand the meaning of this space of certainty, in what way it has been constructed, and how it affects legal, political, social, and cultural mechanisms. The law(s) and legal doctrine, then, come together to form the first expression of legal science. Going further than compilations of Roman law such as the Liber augustalis,3 further than the scientific expressions of jurisprudence of specialists from Bologna, the Île-de-France, and Orleans utroque iure,4 the Partidas—and I should like to insist on this—can be considered a constitutional legal text. In the context of solving large distributed constraint optimization problems, belief-propagation and incomplete inference algorithms are candidates of choice. However, in general, when the problem structure is very cyclic, these solution methods suffer from bad performance, due to non-convergence and many exchanged messages. As to improve performances of the MaxSum inference algorithm when solving cyclic constraint optimization problems, we propose here to take inspiration from the belief-propagation-guided decimation used to solve sparse random graphs. We propose the novel DeciMaxSum method, which (...) is parameterized in terms of policies to decide when to trigger decimation, which variables to decimate and which values to assign to decimated variables. Based on an empirical evaluation on a classical constraint optimization benchmarks, some of these combinations of policies, using periodic decimation, cycle detection-based decimation, parallel and non parallel decimation, random or deterministic variable selection and deterministic or random sampling for value selection, outperform state-of-the-art competitors in many settings. La transgresión que supone la asociación de la violencia con las mujeres se revela en el tratamiento político y mediático que han recibido las mujeres de ETA, frecuentemente asociadas con una feminidad pervertida. Este artículo analiza la identificación del cuerpo de la mujer de ETA con la sexualidad desviada de los modelos normativos nacionalistas, explora las conflictivas relaciones de las mujeres con la violencia y se detiene en las figuras políticas y el liderazgo de Yoyes y de Idoia López Riaño. (...) En el primer caso se analiza la transgresión representada por la presencia inasimilable de una líder de ETA tras su abandono de la actividad terrorista y tras su maternidad. En el segundo se explora su representación y la negociación política y mediática de su identidad. Si Yoyes ocupa un espacio simbólico en el imaginario político vasco, López Riaño constituye un testimonio vivo en el proceso de esta militancia femenina en ETA. (shrink)

Several studies have examined victim blaming in rape scenarios. However, there is limited research on the analysis of the perception of blame when two or more perpetrators are involved. The present article explores the perception of blame in cases involving rape based on the level of resistance shown by the victim and the presence of one or more perpetrators. A study was carried out involving 351 university students who responded to a survey after reading a hypothetical assault scenario. Six situations (...) were established where the victim showed either low or high resistance, depending on whether the resistance was verbal or physical and verbal, and in the presence of one or two male perpetrators. It is expected that perpetrators are more culpable when acting in groups and that less resistance from the victim leads to greater attribution of blame. The results confirm that more blame is attributed to the perpetrators when they act in groups than when they act alone. Likewise, women consider the victim generally exerts greater resistance and this variable influences the attribution of greater blame. (shrink)

Las referencias latentes en este diálogo se hicieron patentes en De Trinitate y en sus sermones sobre San Pablo; esto nos presenta, ahora, la oportunidad de convertir la sutileza en diafanidad. Mediante la interpretación de las concepciones de la felicidad descritas por el filósofo africano en De beata vita se descubrió que subyace en (...) este diálogo una discusión entre epicúreos estoicos y cristianos que ilustra las siguientes divergencias: 1) para dichas escuelas helenísticas la serenidad puede hallarse en una disposición interior, mientras que para los cristianos el anhelo de un Bien trascendente es una condición sine qua non para la vida feliz; y, 2) los estoicos y los epicúreos proponen buscar la felicidad limitando los deseos ; en cambio, los cristianos exaltan el velle o desiderare del Sumo Bien, es decir, Dios. La polarización, los populismos y la posverdad forman tres fenómenos sociopolíticos fundamentales para comprender cómo se está orientando la política en los sistemas demoliberales. La polarización política se suele entender como un proceso dinámico de activación de las divisiones entre dos o más grupos sociales en el transcurso de los debates públicos que puede terminar con una ruptura comunicativa o una comunicación fallida. Si bien los especialistas no coinciden a la hora de definir el populismo, se puede comprender como una (...) forma concreta de construir el pueblo mediante un discurso que contrapone este al anti-pueblo. La posverdad se referiría a una tendencia cultural donde las verdades de hecho sufren una merma en favor de las verdades vivenciadas subjetivamente. Estos fenómenos tienden a ser percibidos por una buena parte de la sociedad y del mundo académico como una amenaza grave para las bases pluralistas y reflexivas de la democracia. Sin embargo, esa consideración está decantada normativamente. Este artículo trata de explorar un marco referencial diferente, el emotivismo, y cómo, desde este ángulo, toman sentido los tres conceptos clave: polarización, populismo y posverdad. (shrink)

This paper concludes a special feature of Sustainability Science that explores a broad range of social value theoretical traditions, such as religious studies, social psychology, indigenous knowledge, economics, sociology, and philosophy. We introduce a novel transdisciplinary conceptual framework that revolves around concepts of 'lenses' and 'tensions' to help navigate value diversity. First, we consider the notion of lenses: perspectives on value and valuation along diverse dimensions that describe what values focus on, how their sociality is envisioned, and what epistemic and (...) procedural assumptions are made. We characterise fourteen of such dimensions. This provides a foundation for exploration of seven areas of tension, between: (1) the values of individuals vs collectives; (2) values as discrete and held vs embedded and constructed; (3) value as static or changeable; (4) valuation as descriptive vs normative and transformative; (5) social vs relational values; (6) different rationalities and their relation to value integration; (7) degrees of acknowledgment of the role of power in navigating value conflicts. In doing so, we embrace the 'mess' of diversity, yet also provide a framework to organise this mess and support and encourage active transdisciplinary collaboration. We identify key research areas where such collaborations can be harnessed for sustainability transformation. Here it is crucial to understand how certain social value lenses are privileged over others and build capacity in decision-making for understanding and drawing on multiple value, epistemic and procedural lenses. Este trabajo tiene como objetivo mostrar y proponer una metodología híbrida de enseñanza-aprendizaje de matemáticas universitarias con las primeras experiencias de un modelo educativo emergente elaborado con base en la “Guía para el retorno a las actividades presenciales en la Universidad Autónoma Metropolitana” (México). Con él se desea probar que la educación presencial y remota ofrecen resultados similares de aprendizaje en matemáticas. Para lograr este objetivo hemos aplicado una propuesta metodológica que combina una clase presencial de matemáticas y una vídeo (...) clase en la sala ZOOM con apoyo de material educativo en Power Point y EXCEL. Background: COVID-19 has taken many lives worldwide and due to this, millions of persons are in grief. When the grief process lasts longer than 6 months, the person is in risk of developing Complicated Grief Disorder. The CGD is related to serious health consequences. To reduce the probability of developing CGD a preventive intervention could be applied. In developing countries like Mexico, the psychological services are scarce, self-applied interventions could provide support to solve this problem and reduce the health impact (...) even after the pandemic has already finished.Aims: To design and implement a self-applied intervention composed of 12 modules focused on the decrease of the risk of developing CGD, and increasing the life quality, and as a secondary objective to reduce the symptomatology of anxiety, depression, and increase of sleep quality. The Intervention Duelo COVID follows the principles of User Experience and is designed according to the needs and desires of a sample of the objective participants, to increase the adherence to the self-applied intervention, considered one of the main weaknesses of online interventions.Methods: A Randomized Controlled Trial will be conducted from the 22nd of December of 2020 to the first of June 2021. The participants will be assigned to an intervention with elements of Cognitive Behavioral Therapy, Acceptance and Commitment Therapy, Mindfulness and Positive Psychology. The control group will be a wait-list condition, that will receive the intervention 1.5–2 months after the pre-measurement were taken. The Power Size Calculation conducted through G*Power indicated the need for a total of 42 participants, which will be divided by 21 participants in each group. The platform will be delivered through responsive design assuring with this that the intervention will adapt to the screen size of cellphones, tablets, and computers.Ethics and Dissemination: The study counts with the approval of the Research Ethics Committee of the Autonomous University of Ciudad Juárez, México, and it is registered in Clinical Trials. The article is sent and registered in clinical trials before the recruitment started. The results will be reported in future conferences, scientific publications, and media. (shrink)

In this article we defend the inferential view of scientific models and idealisation. Models are seen as “inferential prostheses” (instruments for surrogative reasoning) construed by means of an idealisation-concretisation process, which we essentially understand as a kind of counterfactual deformation procedure (also analysed in inferential terms). The value of scientific representation is understood in terms not only of the success of the inferential outcomes arrived at with its help, but also of the heuristic power of representation and their capacity to (...) correct and improve our models. This provides us with an argument against Sugden’s account of credible models: the likelihood or realisticness (their “credibility”) is not always a good measure of their acceptability. As opposed to “credibility” we propose the notion of “enlightening”, which is the capacity of giving us understanding in the sense of an inferential ability. (shrink)

En el texto se describirá la importancia que tienen las ideologías gerenciales como articuladoras del discurso pro-empresarial contemporáneo para, a continuación, señalar las principales contribuciones del libro de Medina-Vicent, que son la de no solo criticar el peculiar tipo de feminismo presente en los libros de literatura empresarial dirigidos a mujeres, sino proponer una reversión de (...) los discursos neoliberales sostenida en las aportaciones de la teoría feminista.: This contribution aims at making an assessment of the work of Maria Medina-Vicent Mujeres y discursos gerenciales: hacia la autogestión feminista. The text will describe the importance of managerial ideologies as articulators of contemporary pro-business discourses. Besides, the main contributions of Medina-Vicent’s book will be highlighted. Those are not only the critique of the peculiar type of feminism underpinning in management books addressed to women, but also the proposal of a feminist theory-based rejection of neoliberal discourses. El presente artículo confronta la abstracción resolutiva con la abstracción inmaterializante tradicional, mostrando, por medio de cuatro vías, que la abstracción resolutiva es una conquista del pensamiento de Tomás de Aquino que conlleva un replanteamiento de la epistemología aquiniana.

In some small-scale societies, a sexual division of labor is common. For subadult hunter-gatherers, the onset of this division dates to middle childhood and the start of puberty; however, there is apparently no physiological explanation for this timing. The present study uses an experimental approach to evaluate possible energetic differences by sex in gathering-related activities. The energetic cost of gathering-related activities was measured in a sample of 42 subjects of both sexes aged between 8 and 14 years. Body mass and (...) other anthropometric variables were also recorded. Our results show that the energetic differences in the simulated gathering activities depend only on body mass. Both sexes expend a similar amount of energy during locomotion activities related to gathering. Discarding the energetic factor, the sexual division of tasks may be explained as an adaptation to acquire the skills needed to undertake the complex activities required during adulthood as early as possible. Carrying out gathering activities during childhood and adolescence could be favored by the growth and development cycles of Homo sapiens. Moreover, if most of the energetic costs of gathering activities depend on body mass, the delayed growth in humans relative to other primates allows subadults to practice these tasks for longer periods, and to become better at performing them. In fact, this strategy could enable them to acquire adults’ complex skills at a low energetic cost that can be easily subsidized by other members of the group. (shrink)

To build a culture of integrity in a HE institution, innovative approaches are needed to enhance education of research ethics and integrity. In addition to educating students, understanding is needed on how to facilitate for those who lead others. The focus is on early-career researchers as future REI leaders. The current study sheds light on how learning and REI leadership competencies evolve during scaffolded collaborative research ethics training for this target group. The study combines new instruments as part of holistic (...) DBR. Data was collected from 3 groups of experienced researchers attending 3 training sessions in the form of written group reports and group discussion recordings. Qualitative deductive analysis was utilised for monitoring the learning process, scaffolding patterns, and display of REI leadership principles. Also, quantitative analysis was applied to group discussion data, displaying the nature of collaboration. Results imply that collaborative case-based role play format is effective in training future REI leaders. All groups displayed high levels of understanding. Combining ECRs and researchers with leadership experience supported knowledge building in the groups by bringing in various perspectives. Even though groups required different amounts of scaffolding, the nature was similar: maintaining goal orientation, highlighting critical features and redirecting learners. Learning analytics of collaboration indicated that the person with leadership experience was not necessarily the most active participant nor took the role of a ‘group leader’. Still, it was mostly that person who displayed leadership competencies thus supporting other group members to develop leadership aspects. (shrink)

The COVID-19 global health emergency has greatly impacted the educational field. Faced with unprecedented stress situations, professors, students, and families have employed various coping and resilience strategies throughout the confinement period. High and persistent stress levels are associated with other pathologies; hence, their detection and prevention are needed. Consequently, this study aimed to design a predictive model of stress in the educational field based on artificial intelligence that included certain sociodemographic variables, coping strategies, and resilience capacity, and to study the (...) relationship between them. The non-probabilistic snowball sampling method was used, involving 337 people from the university education community in south-eastern Spain. The Perceived Stress Scale, Stress Management Questionnaire, and Brief Resilience Scale were administered. The Statistical Package for the Social Sciences was used to design the architecture of artificial neural networks. The results found that stress levels could be predicted by the synaptic weights of coping strategies and timing of the epidemic, with a predictive capacity of over 80% found in the neural network model. Additionally, direct and significant associations were identified between the use of certain coping strategies, stress levels, and resilience. The conclusions of this research are essential for effective stress detection, and therefore, early intervention in the field of educational psychology, by discussing the influence of resilience or lack thereof on the prediction of stress levels. Identifying the variables that maintain a greater predictive power in stress levels is an effective strategy to design more adjusted prevention programs and to anticipate the needs of the community. While research ethics and developing respective competencies is gaining prominence in higher education institutions, there is limited knowledge about the learning process and scaffolding during such training. The global health crisis has made the need for facilitator-independent training materials with sufficient support even more pronounced. To understand how knowledge building takes place and how computer-supported collaborative learning supports research ethics learning, we analysed: 1) how the participants’ understanding was displayed during the collaborative learning process utilising the developed ethics resource; and (...) 2) whether the scaffolding provided by the resource supported the learning process. Epistemic evidence was collected during design-based research involving 36 PhD students and researchers with supervisory experience divided into 11 groups. Data was analysed qualitatively utilising the SOLO taxonomy. The results revealed that: 1) participants displayed high levels of understanding and the need for the facilitator support decreased with the use of the online ethics resource; 2) the learners were able to evaluate their learning outcomes with satisfactory accuracy; 3) when used linearly, the online ethics resource helped learners to achieve high levels of understanding even when the scaffolding gradually faded. Based on the lessons learnt, design principles were extracted to develop research ethics competencies in higher education, and also recommendations for research ethics training were outlined. The increasing concern about ethics and integrity in research communities has brought attention to how students and junior academics can be trained on this regard. Moreover, it is known that ethical behaviour and integrity not only involve individual but also group norms and considerations. Thus, through action research and participant observation, this research investigates the learning processes through which 64 students collaboratively develop research ethics and integrity competencies. The aim was to understand how bachelor, master and PhD students approach ethical (...) dilemma cases through a collaborative process. The data consisted of recorded group work on ethics cases, student group reports, and post-training questionnaires. Later, the analyses considered groups as the unit of analysis. These data were analysed through content analysis utilizing the SOLO taxonomy to identify levels of understanding and assess evolvement of ethical sensitivity during a case-based training session. The results show that all groups reached the level of understanding where the groups demonstrated that concepts had been understood appropriately, but occasionally struggled to make connections between them. Students perceived working collaboratively as beneficial. The results help teachers of research ethics and integrity to make pedagogically justified choices in their teaching. Drawing on the results of this study, we propose a tool for the formative assessment of student learning of research ethics and integrity. (shrink)
